These Terms are a contract between you and [Company name] (registration no. [Company registration no. (SSM)]), [Registered business address] (“NILE Home”, “we”, “us”). By ticking the box when you sign in or by using the platform, you agree to them. If you do not agree, please do not use NILE Home. This English version prevails over any translation.
NILE Home is a platform where people post property listings and service profiles for Penang, Malaysia, and contact each other through in-platform messages. We are not an estate agent, a property manager, a lender or a lawyer, and we are not a party to any deal between users. We show facts and do not score or rate properties.
You must be at least 18 years old and able to make a binding contract. By using NILE Home you confirm this.
You keep ownership of the listings, photos, profile details and messages you post (“your content”). You give NILE Home a free, worldwide, non-exclusive licence to host, store, copy, resize, display and distribute your content on the platform and in its previews, search results and sharing cards, for as long as it is on the platform, and to keep the records the law or a dispute requires. The licence ends when you delete the content, except for copies we must keep (see the Privacy Notice).
You promise that you have the right to post your content, that it is true and not misleading, and that it does not infringe anyone's rights. Only post photos you took or may use.
All posts must follow our posting rules at /post-rules/, which are part of these Terms. In particular you must not post:
If you post as an estate agent, you must hold a valid registration (a Registered Estate Agent (REA) or Probationary Estate Agent (PEA) number, or a Registered Estate Agent Negotiator (REN) number) issued under the Valuers, Appraisers, Estate Agents and Property Managers Act 1981, show it correctly, and follow the rules of the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEAP), including those on advertising. You must tell us if your registration lapses or is revoked. Service providers (bankers, renovators, designers, lawyers) must hold any licence or qualification their work requires.
A tick shows that, at the time we checked, the licence or registration number matched the official register or the documents you supplied. It is a check at one point in time. It is not an endorsement, recommendation, rating or guarantee of the person's conduct, skill, honesty or of any listing. Licences can lapse or be revoked after we check. We can remove a tick at any time, for example if the licence is no longer valid or the rules are broken.
Listings, prices and descriptions are posted by users. We do not check them in advance and we do not guarantee that they are accurate, complete, current or available. Check facts yourself, visit the property, check title and approvals, and get professional advice before you decide, pay a deposit or sign anything. Do not pay money to anyone you have not verified.
Every listing and profile has a Report button. We review each valid report and, if the content breaks the law, these Terms or the posting rules, we remove it within 24 hours of receiving the report. Reports can be sent about any post, profile or message.
We may also remove or hide content, remove a tick, warn, mute or suspend or ban an account at any time, with or without notice, if we believe these Terms, the posting rules or the law have been broken or the platform or its users are at risk. Where we can, we will tell you why. You can ask us to review a decision through the contact page.
Users, not NILE Home, are responsible for what they post. Under section 114A of the Evidence Act 1950, a person who runs a website may be presumed to have published content posted through it. We therefore act on reports quickly (section 10), and we ask you to report anything unlawful or untrue.
Using NILE Home is currently free. We may introduce paid features later (for example for agents). If we do, we will tell you at least 14 days before any charge starts, we will not charge you without your clear agreement, and nothing will renew or bill automatically.
We try to keep the platform available but we do not promise that it will be uninterrupted or error free. We may change, suspend or stop any part of it. Maps and place data come from OpenStreetMap contributors and other sources, are provided as they are, and may contain errors.
To the fullest extent the law allows, NILE Home is provided “as is”. We are not responsible for what users post or do, for any deal, payment, viewing or dispute between users, or for loss caused by relying on a listing, price, tick or map. We are not liable for indirect or consequential loss or loss of profit, opportunity or goodwill. Nothing in these Terms limits liability that cannot be limited by law, including your rights under Malaysian consumer protection law. Where liability cannot be excluded, it is limited to the extent the law allows.
You agree to compensate NILE Home for loss and claims (including reasonable legal fees) that arise from your content, your breach of these Terms or your breach of the law, to the extent the law allows.
How we handle personal data is described in the Privacy Notice at /privacy/. It forms part of these Terms.
We may change these Terms. The version and effective date are below. If the change is material, we will ask you to accept the new version before you can post or send messages. Reading the site stays open. If you do not accept, you can delete your account.
These Terms are governed by the laws of Malaysia. The courts of Malaysia have jurisdiction, subject to any mandatory consumer rights you have. Please contact us first so that we can try to resolve a problem informally.
